VIRTUAL CHOCOLATE SUNDAES AUDIENCE RELEASE

By attending any Virtual Chocolate Sundaes shows online, you consent to being photographed, filmed, and/or otherwise recorded throughout the duration of the Virtual Chocolate Sundaes collection of comedic content filmed and released by Producer virtually for its subscribers (“the Show”). Your registration and entry into the Show, constitutes your consent in granting to Chocolate Sundaes (“Producer”) and to its licensees, assignees, and other successors-in-interest, all rights of every kind and character whatsoever, in perpetuity, including the right to use, display, edit and reproduce any performance or visual appearance you may render on the Show as an audience viewer. You grant to Producer the right to use your name, voice, image, and likeness, for the Show and the results and proceeds thereof (“Performance”) in connection with the virtual production and public airing of the Show. You shall not be allowed to participate in the Show if you do not fully agree to these terms. 

You acknowledge and agree that Producer owns all rights to and proceeds of the Performance and the Show, and all photography, filming and/or recording and any use, in any and all media or formats now known or hereafter developed, throughout the universe, in perpetuity, of your appearance, likeness, voice, for any purpose whatsoever, in connection with the production of the Show, including without limitation unrestricted use for purposes of publicity, advertising, merchandise and sales promotion. Furthermore, you acknowledge that you have no right of approval, no claim for compensation of any kind, no right to enjoin or in any way hinder Producer’s rights hereunder. You waive your right to seek injunctive relief and acknowledge you shall have no claim (including, without limitation, claims based upon defamation, invasion of privacy, or right of publicity) arising out of or in connection with any use, alteration, distortion, or illusionary effect made for the Show and determined by Producer in its sole discretion.

You acknowledge and accept that there is no guarantee that your participation in the Show as a viewer and/or active participant, shall result in the Show being aired or released to the public. Any editing and releasing of the Show to the public will be at Producer’s sole discretion. 

YOU HEREBY WARRANT AND REPRESENT THAT YOU HAVE THE RIGHT TO ENTER INTO THIS RELEASE AGREEMENT AND TO GRANT THE RIGHTS GRANTED TO PRODUCER HEREIN. BY ATTENDING A SHOW AND BEING PROVIDED THIS RELEASE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND FULLY UNDERSTAND THE AGREEMENT’S TERMS, LIMITATIONS AND RESTRICTIONS.
